At the February 18, 2026 Special Board of Supervisors meeting, Recorder Justin Heap was sworn in and forced to give testimony about his office’s operations.

Supervisor Mark Stewart made a motion declaring that Recorder Heap had satisfied the statute and fulfilled his duties under ARS 11-253.

The motion received zero seconds. Chair Kate Brophy McGee quickly ruled it out of order.

Heap calmly explained the situation: a one-time effort to ensure 37 rural voters in two precincts wouldn’t be disenfranchised in the CD7 election. Yet the Board treated it like a major scandal while continuing to push for more control.

This wasn’t about cooperation. It was about power.

Joseph Chaplik on legislative authority versus the strict constitutional limits placed on county boards under Article 12 and Article 8 of the Arizona Constitution. Counties don’t have the same expulsion powers as the Legislature — and the Board knows it.
